SUNCOMPLAINTS.COM · THE COURT RECORD

The Court Record

Every filed case we could document — and how it ended. 45 matters involving Sun Communities, Inc. and its entities, drawn from court dockets, agencies' own publications, and contemporaneous primary reports: the federal antitrust class action, a settled securities class action, an SEC enforcement action, regulators' inquiries, utility rate fights, wrongful-death suits, and the small cases residents filed one by one in county courts. If Sun Communities has a response to anything recorded here, we will publish it alongside.

How this record was built — and what we left out

Every item below is tied to a court docket, an agency's own publication, or a contemporaneous primary report, with sources linked. Outcomes are stated exactly as the records support them — resident wins and resident losses alike, including fee awards entered against resident plaintiffs.

Dispositions. For the Volusia County, Florida cases, dispositions were read from the Clerk's CCMS docket detail on October 15, 2026: all eight cases that had previously been listed only as "closed" ended in dismissal with prejudice — five of them expressly after settlement notices or acceptances — and none reached a verdict. Settlement terms in those cases are confidential and are not stated here. Where a disposition is not publicly indexed (three older Volusia cases: Mullen, Evans, and Van Leuven), we say exactly that rather than guessing whether a case settled, was dismissed, or went to judgment.

Samples are labeled samples. Eviction figures drawn from public indexes are day-slice samples — filings visible on single sampled days — not statewide totals, and a filing is not a judgment.

Pending means alleged. Cases still pending are described in allegation framing only; no court has made the findings the complaints ask for. Settlements are compromises, and where the record states a settlement is not an admission of wrongdoing, we say so.

Application for staff-assisted rate case by Sun Communities Finance, LLC d/b/a Water Oak Utility

Utility rate case — Florida PSC · Florida Public Service Commission · Docket: 20250088-WU · Filed: 2025 · Community: Water Oak Country Club Estates

Sun Communities Finance, LLC d/b/a Water Oak Utility sought new water rates in a staff-assisted rate case. Residents filed extensive objections alleging 200–300 broken or non-functioning water meters left unrepaired for over two years, roughly 32% of pumped water unbilled, 17 general-service customers never billed in the test year, and the resulting costs shifted to paying customers. PSC staff nonetheless recommended the quality of service be found satisfactory, found the system 100% used-and-useful with a 29.7% excessive-unaccounted-for-water adjustment, and set ROE at 8.51%.

Outcome: REGULATORY DECISION — Commission voted 2026-04-07 to approve new water rates substantially as staff recommended (typical 3,000-gal residential bill from $8.95 to roughly $35–$37); residents' objections (broken meters, 32.3% unbilled water) noted on the record · Outcome date: 2026-04-07 (Commission vote)

Sun entities as eviction plaintiffs — Florida county-court samples

Eviction-filing pattern — day-slice samples · Not a filed case · Florida county courts (UniCourt public indexes; Volusia CCMS) · Docket: Multiple · Filed: Samples from 2021–2024

A full statewide count is not available from public web indexes. Day-slice samples show Sun's operating entity as a repeat eviction plaintiff: Orange County day-listings show Sun Communities Operating Limited Partnership (with the Deerwood community entities) filing residential evictions on single sampled days across years — two filings on 2022-05-09, one on 2023-11-15, one on 2024-02-05; a single Polk County day (2021-01-07) shows three Sun Communities Operating Limited Partnership residential-eviction filings; and the Volusia index includes numerous La Costa Property LLC residential evictions (2010–2019), with Sun also appearing as plaintiff in evictions at Holly Forest Estates (Holly Hill). Read fairly: these are day-slice samples from public indexes, not a total. They establish a pattern of routine eviction filing by Sun entities in at least three Florida counties; they do not establish a statewide count.

Outcome: Pattern documented from day-slice samples — not a statewide count; filings are not judgments

State court — wrongful death · Grand Traverse County Circuit Court (13th Circuit), Michigan (per filing reports) · Docket: Not published in sources located · Filed: Dec 19, 2024 · Community: King's Court

Kimberly Gilbert sued Traverse City Area Public Schools and its officials, Sun Communities, Inc., Northern Michigan Water LLC, and the driver after her 8-year-old son, Jayson Hoogeveen, was struck and killed on September 3, 2024 — the first day of school — at the King's Court school bus stop. The complaint alleges the stop was unreasonably dangerous (located in the active management-office parking lot, under 200 feet from an intersection, without proper signage), that roughly 40–50 formal complaints about the stop had been made over several years, that TCAPS and Sun planned in spring 2023 to relocate the stop but did not do so until about two months after the death, and that the driver was distracted by Sun Communities paperwork while backing up. Independence Commons (Potterville) drinking-water contamination suit

State court — PRE-SUN (not charged to Sun) · Eaton County, Michigan (per news reports) · Docket: — · Filed: Jan 9, 2019 · Community: Independence Commons

PRE-SUN — not charged to Sun. This matter predates Sun's ownership of the property and is recorded so the property's history is not misattributed.

Three families sued the City of Potterville and Independence Commons, alleging exposure to fecal-bacteria-contaminated water and air caused serious illness and that complaints went unaddressed. The Michigan DEQ cited the city, whose wastewater plant adjacent to the park was the alleged contamination source, and said the plant was not a health hazard. Sun Communities acquired Independence Commons in 2025 — six years after this suit was filed; the litigation is not a Sun-era matter and is recorded only so it is not misattributed.

Outcome: PRE-SUN — flagged. Suit named the City of Potterville and the park under prior ownership; Sun acquired the park in 2025. Contamination source alleged to be the city's adjacent wastewater plant; MI DEQ cited the city. Outcome vs. Sun: none — Sun was not the owner

Sun's follow-on coverage suit against its insurer is in the federal section.
